Regulations of the online store

§1
Preliminaries
- The www.zintronic.pl online store is owned by Zintronic Marek Ziniewicz conducted as a business activity entered into the Central Register and Information on Economic Activity (CEIDG) NIP 9532741233, REGON 369065284.
- These Regulations are addressed to both Consumers and Entrepreneurs using the Store and define the rules for using the Online Store and the rules and the mode of concluding Sales Agreements with the Customer remotely via the Store.
§2
Definitions
- Consumer - a natural person concluding a contract with the Seller as part of the Store, the subject of which is not related directly related to its business or professional activity.
- Seller - natural person prunning business activity under the name Zintronic Marek Ziniewicz, entered into the Central Register and Information on Economic Activity (CEIDG), NIP 9532741233, REGON 369065284
- Customer - any entity making purchases via the Store.
- Entrepreneur - natural person, legal person and organizational unit that is not a legal person, whose separate act grants legal capacity, performing business activity on its own behalf, which uses the Store.
- Shop - an online store run by the Seller at the Internet address www.zintronic.pl.< /span>
- Distance contract - contract concluded with the Customer as part of an organized system for concluding distance contracts (as part of the Store), without the simultaneous physical presence of the parties, with the sole use of one or more means of distance communication up to and including the moment of concluding the contract.
- Regulations - these Shop regulations.
- Order - Customer's declaration of will submitted via the Order Form and aimed directly at concluding a Sales Agreement Product or Products with the Seller.
- Account - customer account in the Store, it collects data provided by the Customer and information about Orders placed by him in the Store.
- Registration form - a form available in the Store to create an Account.< /li>
- Order Form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
- Cart – an element of the Store's software in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.
- Product - movable item/service available in the Store, which is the subject of the Sales Agreement between the Customer and the Seller .
- Sales Agreement - Product sales agreement concluded or concluded between the Customer and the Seller via the Online Store .

§4
Technical requirements
- To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:
- terminal device with access to the Internet and a web browser such as Internet Explorer, Edge, Chrome, Firefox, etc.,
- active e-mail account,
- cookies enabled,
- FlashPlayer installed.
§5
General
- The Seller, to the fullest extent permitted by law, shall not be liable for any disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized activity third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
- Browsing through the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data enabling the execution of the Order without creating an Account.
- Prices given in the Store are given in Polish zlotys and are gross prices (including VAT).< /li>
§6
Creating an Account in the Store
- To set up an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data: Name, Surname, Email Address and create a unique password.
- Creating an Account in the Store is free.
- Logging in to the Account is done by entering the login and password set in the Registration Form.
- The Customer may at any time, without giving any reason and without incurring any fees, delete the Account by sending an appropriate request to the Seller, in particular via e-mail or in writing to the addresses provided in § 3.

Ordering rules
To place an Order, please:
- log in to the Store (optional) ;
- select the Product being the subject of the Order, and then click the "Add to Cart" button (or equivalent);
- log in or use the option to place an Order without registration;
- if the option of placing an Order without registration has been selected - fill in the Order Form by entering the details of the Order recipient and the address to which the delivery is to be made of the Product, select the type of shipment (method of delivery of the Product), enter the invoice details, if different from the details of the recipient of the Order (from at the beginning of 2020, after the entry into force of the new regulations on issuing invoices to receipts, the buyer's NIP number on the receipt will be a necessary element of the receipt; if the NIP is not provided, it will not be possible to issue an invoice), select one from the available payment methods and depending on the payment method, pay for the order within the specified period, subject to § 8 point 3.

§8
Offered delivery and payment methods
- The Customer may use the following methods of delivery or collection of the ordered Product:
- Courier delivery, COD courier delivery,
- Parcel locker shipment, COD parcel locker shipment

- The customer can use the following payment methods:
- Cash on delivery
- Cash on delivery
- Payment by bank transfer to the Seller's account
- Przelewy24 electronic payments
- Detailed information on delivery methods and acceptable payment methods can be found on the Store's website.
§9
Execution of the sales contract
- The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Online Store in accordance with § 7 of the Regulations.
- After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation takes place by sending the appropriate e-mail to the Customer by the Seller to the Customer's e-mail address provided when placing the Order, which contains at least the Seller's statement on receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.
- If selected by the Customer:
- Payments by Przelewy24, the Customer is obliged to make the payment at the time of placing the order, in the case of choosing a traditional transfer to the account within 5 working days from the date of concluding the Sales Agreement - otherwise the order will be canceled.
- cash on delivery upon receipt of the shipment, the customer is obliged to make the payment upon receipt of the shipment.
- cash payments upon personal collection of the shipment, the customer is obliged to make the payment upon receipt of the shipment within 3 working days from the date of receipt of information about the readiness of the shipment for collection.
- If the Customer has chosen a delivery method other than personal collection, the Product will be sent by the Seller within the time limit indicated in its description (subject to paragraph 5 of this paragraph), in the manner chosen by the Customer when placing the Order.
- A In case of ordering Products with different delivery dates, the delivery date is the longest given date.
B In the case of ordering Products with different delivery dates, the Customer has the option of requesting delivery of the Products in parts (then separate sales documents will be issued depending on the number of deliveries) or delivery of all Products after completing the entire order.
- The beginning of the period of delivery of the Product to the Customer is counted as follows:
- If the Customer chooses the method of payment by traditional transfer, Przelewy24 - from the date of crediting the Seller's bank account.
- If the Customer chooses the method of payment on delivery - from the date of conclusion of the Sales Agreement,
- If the Customer chooses to collect the Product in person, the Product will be ready for collection by the Customer within the time limit indicated in the Product description. The Customer will be additionally informed about the readiness of the Product for collection by the Seller by sending an appropriate e-mail to the Customer's e-mail address provided when placing the Order.
- In the case of ordering Products with different dates of readiness for collection, the Customer has the option of collecting the Products in parts (according to their readiness for collection, then separate sales documents will be issued depending on the number of collections) or collecting all Products after completing the entire order.
- The beginning of the period of the Product's readiness for collection by the Customer is counted as follows:
- If the Customer chooses the method of payment by bank transfer, electronic payments or payment card - from the date of crediting the Seller's bank account.
- If the Customer chooses cash on collection - from the date of conclusion of the Sales Agreement.
- Delivery of the Product takes place within the European Union.
- Delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. Product delivery costs (including charges for transport, delivery and postal services) are indicated to the Customer on the Online Store's website in the "Delivery costs" tab and when placing the Order, including when the Customer expresses his will to be bound by the Sales Agreement. li>
- Personal collection of the Product by the Customer is free of charge.
§10
Right of withdrawal
- The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
- The time limit specified in par. 1 § 10 begins with the delivery of the Product to the Consumer or a person indicated by him other than the carrier.
- The consumer may withdraw from the Agreement by submitting a declaration of withdrawal from the Agreement to the Seller. To meet the withdrawal deadline, it is enough for the Consumer to send a statement before the expiry of this period.
- The statement may be sent by traditional mail or electronically by sending a statement to the Seller's e-mail address or by submitting a statement on the Seller's website - the Seller's contact details are specified in § 3. The statement can also be submitted on the form, the template of which is attached as Appendix 1 to these Regulations and as an attachment to the Act of 30 May 2014 on consumer rights, however, it is not mandatory.
- If the Consumer sends a statement electronically, the Seller shall immediately send the Consumer to the e-mail address provided by the Consumer a confirmation of receipt of the statement of withdrawal from the Agreement.
- Consequences of withdrawing from the Agreement:
- In the event of withdrawal from a distance contract, the contract is considered void.
- In the event of withdrawal from the Agreement, the Seller returns to the Consumer immediately, not later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Agreement, all payments made by him, including the costs of delivering the item, with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest usual method of delivery offered by the Seller.
- The Seller will return the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer expressly has agreed to a different solution, which will not involve any costs for him.
- The seller may withhold the refund until the product is returned.
- The consumer should return the Product to the Seller's address provided in these Regulations immediately, no later than 14 days from the date on which he informed the Seller to withdraw from the Agreement. The deadline will be met if the Consumer sends back the Product before the expiry of the 14-day period.
- The consumer bears the direct cost of returning the Product, including the cost of returning the Product if, due to its nature, the Product could not be normally sent back by post.
- According to Art. 34 sec. 4 of the Act on Consumer Rights - the consumer is liable for the decrease in the value of the item as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item (unless the entrepreneur did not inform the consumer about the right to withdraw from the contract in accordance with the requirements of art. 12 par. 1 point 9 of the Act on Consumer Rights). By this we mean removing the product from the box, removing the protective foil, connecting to the power supply and checking the correct operation, not assembling.
- The right to withdraw from a distance contract is not entitled Consumer in relation to the Agreement:< /span>
- in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to meet his individual needs,< /li>
- in which the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or for hygienic reasons, if the packaging has been opened after delivery,
- for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the service that after fulfillment of the service by the Seller will lose the right to withdraw from the Agreement,
- in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items,

Complaint and warranty
- The Sales Agreement covers new and used Products. The condition of each used Product is described in detail on the Store's pages.
- The seller is obliged to provide the customer with a defect-free item in the case of purchasing a new product.
- In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions on warranty in the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.
- It is recommended that the complaint include, among others: a concise description of the defect, circumstances (including the date) of its occurrence, details of the Customer submitting the complaint, and the Customer's request in connection with the defect of the goods.
- The Seller will respond to the complaint request immediately, and if the Customer is a Consumer - no later than within 14 days. If the Customer is a Consumer and the Seller does not respond to the complaint request within 14 days, it is considered that the Customer's request was justified.
- For an exchange or return to be accepted, it is absolutely necessary that: the part is in perfect condition (unused, no signs of assembly ), the product must be complete and undamaged, the part can only be returned in its original packaging; undamaged, without any descriptions, signatures and not covered with any additional tape directly on the box without any additional protection, any stickers, the packaging must be in an additional, protective box/carton for shipping (pay attention that heavy and delicate parts do not move, and everything was immobilized) to protect the product and its original packaging during transport.
- Goods returned under the complaint procedure should be sent to the address received after completing the electronic return form.
- If a warranty has been granted for the Product, information about it and its content will be included in the description of the Product in the shop.

Out-of-court ways of dealing with complaints and pursuing claims
- Detailed information on the possibility for the Consumer to use out-of-court complaint and redress methods and the rules of access to these procedures are available at offices and on the websites of poviat (municipal) Consumer Ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspection and at the following Internet addresses of the Office of Competition and Consumer Protection:

- The consumer has the following exemplary possibilities of using extrajudicial means of dealing with complaints and pursuing claims:
- The consumer is entitled to apply to the permanent amicable consumer court referred to in art. 37 of the Act of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle a dispute arising from the Agreement concluded with the Seller.
- The consumer is entitled to apply to the provincial inspector of the Trade Inspection, in accordance with art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.
- The consumer may obtain free assistance in resolving the dispute between him and the Seller, also using the free assistance of the poviat (municipal) Ombudsman Consumers or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).

Cookies Policy
- The website does not automatically collect any information, except for information contained in cookie files.
- Cookies are IT data, in particular text files, which are stored on the end device of the Website User and are intended for using the Website pages. Cookies usually contain the name of the website they come from, their storage time on the end device and a unique number.

- Cookies are used to:
- adapting the content of the Website pages to the User's preferences and optimizing the use of websites; in particular, these files allow to recognize the Website User's device and properly display the website, tailored to his individual needs;

- maintaining the Website User's session (after logging in), thanks to which the User does not have to re-enter the login and password on each subpage of the Website;

- In many cases, software used for browsing websites (web browser) allows cookies to be stored on the User's end device by default. Website users may change their cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform about each time they are placed on the Website User's device. - The operator of the website informs that restrictions on the use of cookies may affect some of the functionalities available on the websites of the website.
- Cookies placed on the Website User's end device may also be used by advertisers and partners cooperating with the Website operator. span>

§15
Personal data in the Online Store
- The administrator of Customers' personal data collected via the Online Store is the Seller.
- Customers' personal data collected by the Administrator via the Online Store are collected for the purpose of implementing the Sales Agreement, and if the Customer agrees consent - also for marketing purposes.
- Recipients of personal data of Online Store Customers may be:
- In the case of a Customer who uses the Online Store with the method of delivery by post or courier - the Administrator provides the Customer's collected personal data a selected carrier or intermediary performing shipments at the request of the Administrator.
- In the case of a Customer who uses the Online Store with the method of electronic payment or payment card - the Administrator provides the collected personal data of the Customer, a selected entity servicing the above payments in the Online Store.
- The customer has the right to access his data and correct (change) it.
- Providing personal data is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude a Sales Agreement results in the inability to conclude this contract .
§16
Final Provisions

- Agreements concluded via the Online Store are concluded in Polish.
- The Seller reserves the right to amend the Regulations for important reasons, i.e.: changes in the law, changes in payment and delivery methods - to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer of any change at least 7 days in advance.
- In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on Provision of Services by Electronic Means; Consumer Rights Act, Personal Data Protection Act.
- The customer has the right to use extrajudicial means of dealing with complaints and pursuing claims. For this purpose, he may submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/
